The defense has rested its case in the trial of Daniel Penny, the former Marine who held Jordan Neely in a fatal chokehold on the New York City subway last year, after four days of witness testimony.

A forensic pathologist disputes a New York City medical examiner’s determination that former Marine Daniel Penny killed another man by placing him in a chokehold on a subway train last year.

Dr. Satish Chundru, a forensic pathologist based in Texas, told jurors in Manhattan Supreme Court that Neely's autopsy records and video of the fatal F train altercation in May 2023 didn't show signs typical of known chokehold deaths.

Jordan Neely died from the “combined effects” of a number of a factors, not a chokehold, a forensic pathologist hired by Daniel Penny’s attorneys testified Thursday.

The testimony came as defense lawyers to put the homeless man's mental health history at the center of the second-degree manslaughter and criminally negligent homicide case against Daniel Penny, a West Islip native.

It’s my medical opinion that there are no alternative reasonable explanations for Mr. Neely’s death,” the medical examiner, Dr. Cynthia Harris, told jurors Friday.
