Lyle and Erik Menendez face another setback in their quest for freedom as California legal institutions pump the brakes on their resentencing hearing following the election of new District Attorney-elect Nathan Hochman.

A judge has delayed until January his decision on whether to resentence Erik and Lyle Menendez for killing their parents in their Beverly Hills mansion 35 years ago.

A Superior Court Judge had set Tuesday as a deadline for outgoing District Attorney George Gascón's office to respond to the questions about whether evidence regarding the abuse the brothers suffered

The Menendez brothers, who were convicted of killing their parents in their Beverly Hills mansion in 1989, will have to wait until next year to find out if they can be released from prison.
